Terms of Service
Effective date: October 6, 2026 · Last updated: October 6, 2026
IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 23) THAT AFFECT HOW DISPUTES ARE RESOLVED. YOU MAY OPT OUT WITHIN 30 DAYS AS DESCRIBED IN THAT SECTION.
These Terms of Service ("Terms") are a legal agreement between you and Rejuvyx Health, LLC ("Rejuvyx," "we," "us," or "our") governing your use of the Rejuvyx website at rejuvyxhealth.com, the Rejuvyx patient portal, the Rejuvyx mobile app, and related services (the "Services"). By accessing or using the Services, creating an account, or making a purchase, you agree to these Terms. Our Website Privacy Notice explains how we handle personal information. If you don't agree, don't use the Services.
If you use the Services on behalf of another person, you confirm that you're their legal guardian or legally authorized representative, that they are at least 18 years old, and that they agree to these Terms. Their account must be in their name, and care is provided to them, not to you.
1. Our Role
Rejuvyx is a marketing and technology platform that facilitates access to services provided by independent licensed healthcare providers and other third parties. We are not a healthcare provider, and we don't practice medicine, provide medical advice, diagnose, prescribe, or treat. We don't control or interfere with the professional judgment of the independent healthcare providers, pharmacies, or laboratories available through the Services, each of which is solely responsible for the services it provides.
Using the Services doesn't create a provider-patient relationship with us. Any provider-patient relationship is solely between you and your provider.
Healthcare providers, pharmacies, and laboratories may have their own terms, privacy policies, Notices of Privacy Practices, consent forms, and other policies governing the services they provide. These Terms govern your use of the Rejuvyx Services.
2. Eligibility
You must be at least 18 years old to use the Services. You must not be barred from using the Services under applicable law, and you must not have been previously removed from the Services.
The Services are available only in U.S. states where the applicable services are offered. When receiving healthcare services through the platform, you must accurately provide your physical location and meet any eligibility requirements established by the applicable healthcare provider or required by law.
By using the Services, you represent that you meet these requirements. We may ask you to verify your eligibility.
3. Changes to These Terms
We may update these Terms. If changes are material, we'll notify you by email or through the Services before they take effect. For material changes, we may ask you to accept the updated Terms before you continue using the Services; otherwise, continuing to use the Services after the effective date means you accept them. Changes won't apply to disputes that arose before the changes took effect. Changes to Section 23 won't apply to claims you've already notified us of.
4. Accounts
You must provide accurate, complete information and keep it up to date. Keep your login credentials confidential. You're responsible for activity under your account, and you must notify us promptly at support@rejuvyxhealth.com of any unauthorized use. Each account is for one person.
We aren't responsible for losses caused by unauthorized use of your account resulting from your failure to keep your login information secure. We may refuse or cancel any registration at our discretion, subject to applicable law.
We may treat communications, instructions, or orders submitted through your account as authorized by you unless we have reason to believe your account has been compromised. You may not sell or transfer your account.
5. Using the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.
We may change, suspend, or discontinue any part of the Services at any time, without liability to you except as required by applicable law.
6. Acceptable Use
You may not:
- Use the Services in violation of any law or anyone else's rights.
- Harass, threaten, or abuse others, including our staff and providers.
- Upload malware or interfere with the security or performance of the Services.
- Scrape, crawl, or data mine the Services without our permission, including to train AI or machine learning models.
- Reverse engineer the Services, except where the law allows it.
- Create accounts by automated means or impersonate any person.
- Circumvent access controls or resell access to the Services.
You may not provide false or misleading information about your identity, location, or medical history, including to obtain care, prescriptions, or other products, and you may not resell or share any medication or product obtained through the Services.
We may investigate suspected violations and take action, including removing content, suspending accounts, or reporting to law enforcement, subject to applicable law.
7. Purchases, Pricing, and Payment
Prices are in U.S. dollars and are shown at checkout. Payments are processed by Stripe and by Wizpay, a payment service of Wizlo, under their own terms. The descriptor appearing on your payment method statement may vary depending on the payment processor, transaction, or service involved. Product descriptions and images are approximate, and medication you receive may look different from what's shown on the Services. We may correct pricing errors.
Submitting an order or payment does not guarantee acceptance, availability, treatment, or a prescription. We may refuse or cancel an order where permitted by law, including because of suspected fraud, resale, pricing or availability errors, or other circumstances that prevent us or an applicable third party from fulfilling the order.
If you have a billing problem, please contact us promptly so we can try to resolve it. To the extent permitted by applicable law, we ask that billing disputes be submitted to us in writing within 60 days of the charge. Nothing in these Terms limits any rights you may have under applicable law.
You confirm that you're authorized to use the payment method you provide. We aren't responsible for fees your bank or card issuer charges. If your payment is declined, we may retry it. We may receive updated card information from your card issuer and use it for future payments.
Taxes shown at checkout are estimates and may be adjusted. Where we don't collect sales tax, you may be responsible for reporting and paying it.
Amounts charged through the Services may include fees associated with services provided by independent healthcare providers, pharmacies, laboratories, or other third parties.
Completing an intake form, meeting screening criteria, or paying for a consultation doesn't guarantee you'll qualify for treatment or receive a prescription. Those decisions are made by the independent healthcare provider based on their clinical judgment.
We don't bill Medicare, Medicaid, or private insurance for our services or products. By using the Services, you choose to pay directly, you're responsible for all costs, and no claims will be submitted to any government program or insurer on your behalf. Payments you make to us may not count toward your insurance deductible or out-of-pocket maximum. Check with your insurer.
Our memberships and programs aren't insurance and aren't a substitute for health insurance.
Prescriptions are filled by independent licensed pharmacies, which dispense your medication under their own terms and policies. Where required by law, you may ask your provider to send your prescription to a pharmacy of your choice, although pricing and plan benefits may differ.
Compounded medications aren't FDA-approved and haven't been reviewed by the FDA for safety, effectiveness, or quality. Your independent provider will determine whether a compounded medication is appropriate for your individual medical needs.
Prescriptions for controlled substances, such as testosterone, are subject to additional federal and state requirements, which may include an in-person evaluation. Your independent provider determines what's required, under the provider's own terms and consents.
Read and follow all product labels, warnings, and instructions. We aren't responsible for harm resulting from misuse or failure to follow them.
You're responsible for the internet access, devices, and data charges needed to use the Services.
8. SMS Program Terms
Rejuvyx Health text messages. We send two kinds of text messages:
- Order updates and service texts, about your account, orders, shipping, and support, sent because you gave us your number for that purpose. Reply STOP to stop them.
- Promotional texts, about offers, products, and news. By opting in, you agree to receive recurring automated marketing text messages from Rejuvyx Health at the number you provide. Consent isn't a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply STOP to cancel, HELP for help. We also honor other reasonable requests to opt out. For support, email support@rejuvyxhealth.com.
Opting out of promotional texts doesn't stop order updates and service texts. Carriers aren't liable for delayed or undelivered messages. See our Website Privacy Notice for how we handle your information.
You confirm that you're the subscriber or authorized user of the mobile number you provide, and you'll let us know if you change or give up that number.
To stop marketing calls, tell us during a call or email support@rejuvyxhealth.com with "Do Not Call."
9. Promotions and Referrals
From time to time, Rejuvyx may offer promotional discounts, credits, referral programs, or other incentives, subject to applicable terms, eligibility requirements, and law.
Promotions and referral credits have no cash value, aren't transferable, and may expire or be modified, suspended, or discontinued where permitted by applicable law. We may void rewards for fraud, abuse, self-referrals, or violations of applicable program rules.
Promotional offers and referral incentives are available only where permitted by applicable federal and state laws. No promotion or incentive is intended to induce or reward an unlawful referral, influence independent medical judgment, or encourage medically unnecessary services. We reserve the right to restrict, modify, or discontinue any promotion or referral program to comply with applicable healthcare laws and regulations.
If a promotion's specific rules conflict with these Terms, those rules govern for that promotion, except that our dispute resolution, disclaimer, and limitation of liability sections apply to the extent permitted by law.
If you provide another person's contact information, you confirm that you have their permission for us to contact them.
10. Plans and Automatic Renewal
Rejuvyx memberships and medication plans automatically renew at the end of each billing period unless you cancel. By enrolling in an automatically renewing plan, you authorize us to charge your payment method at the price and frequency disclosed to you when you enroll, until you cancel.
Plan terms, pricing, billing frequency, automatic renewal, cancellation, and refund eligibility are described at checkout and in our Subscription, Cancellation & Refund Policy, which is part of these Terms.
You may cancel an automatically renewing plan using the cancellation methods described in our Subscription, Cancellation & Refund Policy. Cancellation stops future renewals but does not automatically entitle you to a refund for amounts already charged, except as required by law or provided in our Subscription, Cancellation & Refund Policy.
11. Shipping, Returns, and Refunds
Shipping and delivery dates are estimates and aren't guaranteed. Prescription medications are shipped by the dispensing pharmacy, not by Rejuvyx. We aren't responsible for delays caused by shipping carriers, weather, incorrect or incomplete delivery information you provide, or other circumstances outside our reasonable control, except as required by applicable law. Lost, damaged, or compromised shipments are handled under the "Lost or Damaged Shipments" section of our Subscription, Cancellation & Refund Policy. Returns and refunds, including for medications and consultation fees, are governed by our Subscription, Cancellation & Refund Policy.
12. Lab Testing
Lab test kits and testing are provided by independent laboratories. Lab tests have limitations and may produce false positive, false negative, incomplete, or inconclusive results. Lab results should not be interpreted as a diagnosis or used to make treatment decisions without review by an appropriate licensed healthcare provider.
13. AI Features
Some features of the Services, such as chat or support features, may use artificial intelligence or automated technologies. Responses generated by these technologies may be inaccurate, incomplete, or inappropriate for your circumstances and should not be relied upon as medical advice.
AI and automated features do not diagnose medical conditions, prescribe treatment, or replace the judgment of a licensed healthcare provider. Questions about your health, medication, treatment, dosing, or lab results should be directed to your healthcare provider. AI features won't present themselves as a licensed healthcare provider. Information you share with an AI feature is handled as described in our Website Privacy Notice.
14. Health Information Disclaimer
Content on the Services, including our advertisements, is for general informational purposes only and isn't medical advice or personalized medical advice. Always consult a qualified healthcare professional about your situation.
The Services aren't for emergencies. If you think you have a medical emergency, call 911 or go to the nearest emergency room. Don't use our website, forms, email, or social media messaging to request emergency help, and don't delay treatment while waiting for a response from us or a provider.
Care+ coaches. Rejuvyx Care+ coaches are not licensed healthcare providers. They may provide general support, education, coaching, and assistance relating to the platform, your account, orders, and Services, but they do not diagnose medical conditions, prescribe or modify treatment, or provide medical advice. Questions about your health, medication, dosing, treatment, or lab results should be directed to your healthcare provider.
Before receiving care, you may be required to accept separate documents from your provider, such as treatment or telehealth consent forms, financial policies, and privacy notices.
Telehealth has limitations compared with in-person care. Whether telehealth is appropriate for you is decided by your independent provider, as described in your provider's telehealth consent.
Treatment results vary from person to person and aren't guaranteed.
Messages sent through our website or Services may not receive an immediate response. Don't use messaging for urgent or emergency needs.
You're responsible for reading and responding to messages from your provider and for following treatment instructions. We aren't responsible for harm resulting from your failure to do so.
We don't guarantee that any medication or treatment will remain available. If a shortage or regulatory change affects a treatment, any alternatives are determined by your independent provider.
Rejuvyx does not make clinical recommendations or determine which provider, medication, test, or treatment is appropriate for you. Those decisions are made by the applicable licensed healthcare provider based on their independent professional judgment.
Email and standard text messaging may not be secure or encrypted end-to-end and may be intercepted. Please don't send detailed health information through these channels unless instructed to do so through an approved communication method.
15. Intellectual Property
We and our licensors own the Services, including their content, software, trademarks, and logos. Except for the limited license in these Terms, no rights are granted to you. Don't use our trademarks without our written permission.
16. Feedback
If you send us feedback or ideas, you grant us a perpetual, irrevocable, royalty-free right to use them for any purpose, without compensation or attribution to you.
17. Third-Party Services and Links
The Services may include, integrate with, or link to third-party services and websites, which may be governed by those third parties' own terms and policies. We are not responsible for third-party services, content, products, or practices except to the extent required by applicable law.
18. Privacy
Our Website Privacy Notice explains how we handle personal information.
19. Termination
You may stop using the Services at any time, and you may ask us to close your account by emailing support@rejuvyxhealth.com. If you have an active Rejuvyx subscription, a request to close your account will also be treated as a request to cancel future automatic renewals of that subscription. Medication orders already submitted for processing or fulfillment remain subject to the applicable cancellation and refund provisions, to the extent permitted by law.
We may suspend or terminate your access to the Services where permitted by applicable law, including for violations of these Terms, suspected fraud or misuse, security concerns, nonpayment, or conduct that may harm Rejuvyx, our users, healthcare providers, pharmacies, laboratories, or other third parties.
When your access ends, your right to use the Services stops immediately. Fees already paid aren't refundable except as required by law or provided in our Subscription, Cancellation & Refund Policy. We may retain or delete information associated with your account in accordance with applicable law and our Website Privacy Notice.
If we terminate your access, you may not create a new account without our permission.
Sections that by their nature should survive termination will survive, including those relating to intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution.
20. Disclaimers
In the Disclaimers, Limitation of Liability, and Indemnification sections, "we," "us," and "our" mean Rejuvyx Health, LLC and its owners, officers, employees, contractors, and agents — but not independent healthcare providers, pharmacies, laboratories, sellers, or other third parties offering products or services through the Services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DON'T WARRANT THAT CONTENT ON THE SERVICES IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
Testimonials, case studies, and examples on our Site reflect individual experiences. Results vary and are not guaranteed.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND REGARDLESS OF THE LEGAL THEORY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), OR STATUTE, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM OR $100. THESE LIMITS DON'T APPLY WHERE PROHIBITED BY LAW. THESE LIMITATIONS ARE AN ESSENTIAL PART OF THE AGREEMENT BETWEEN YOU AND US.
WE AREN'T LIABLE FOR THE ACTS OR OMISSIONS OF INDEPENDENT HEALTHCARE PROVIDERS, PHARMACIES, LABORATORIES, OR OTHER THIRD PARTIES.
22. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold us harmless against any third-party claims, including reasonable attorneys' fees and costs, arising from your content, information you provide that is false or inaccurate, your violation of these Terms, the law, or anyone else's rights (including privacy and intellectual property rights), or your misuse of the Services. We may control the defense of any claim you're required to indemnify us for, and you'll cooperate with us.
23. Governing Law and Dispute Resolution
Governing law. These Terms are governed by the laws of the State of South Carolina, excluding its conflict-of-laws rules. The state and federal courts in Richland County, South Carolina have exclusive jurisdiction over any claim not subject to arbitration, and you consent to personal jurisdiction there. The Services are operated from South Carolina. If you access them from elsewhere, you're responsible for complying with local laws.
Informal resolution first. Before starting arbitration, you and we agree to try to resolve any dispute informally. Send a written notice of dispute to support@rejuvyxhealth.com (or to our mailing address below). Your notice of dispute must be personally signed by you, describe your claim and the relief you seek, and concern only your own dispute. We'll try in good faith to resolve the dispute for 30 days after the notice is received. The informal resolution process includes a call or video conference in which you personally participate (your lawyer may join) and in which a Rejuvyx representative with authority to settle participates. We'll follow the same notice requirements if we have a dispute with you. Deadlines, including statutes of limitation, are paused while it's underway. Completing the informal resolution process is required before either party can start arbitration.
Binding arbitration. If the dispute isn't resolved informally, it will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules and Mediation Procedures and, where applicable, its Mass Arbitration Supplementary Rules, as then in effect. Arbitration fees and costs will be allocated in accordance with the applicable AAA rules and fee schedules. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
CLASS ACTION AND JURY TRIAL WAIVER. YOU AND WE AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek an injunction in court to stop infringement of its intellectual property rights.
Delegation. The arbitrator decides questions about the scope and enforceability of this arbitration agreement, except for claims that applicable law says can't be arbitrated, and except that only a court may decide whether the class action waiver is enforceable.
Severability. If the class action waiver is found unenforceable for a claim, that claim will be decided by a court, not in class arbitration. If a claim for public injunctive relief can't be arbitrated under applicable law, that claim will be decided by a court after the arbitration is complete.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@rejuvyxhealth.com within 30 days after you first accept these Terms, with your name, your account email, and a clear statement that you're opting out of arbitration. Opt-outs must be sent by you individually; opt-outs submitted by others on your behalf aren't effective. If you previously agreed to arbitration and didn't opt out, later changes don't create a new opt-out window; we'll honor prior valid opt-outs.
Time limit. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Services must be brought within one year after the claim accrues, unless applicable law requires a longer period that cannot be shortened by agreement.
24. Mobile App Stores
If you download our app from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google. We, not Apple or Google, are solely responsible for the app, including its maintenance, support, and any product or intellectual property claims relating to it. Your license to use the app is limited to devices you own or control, as permitted by the app store's usage rules. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the app's purchase price (if any); Apple has no other warranty obligation for the app. You confirm that you aren't located in a country subject to a U.S. government embargo and aren't on any U.S. government list of prohibited or restricted parties. You must comply with any applicable third-party terms, such as your wireless carrier's, when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the app and may enforce them against you. Google Play's terms also apply to downloads from Google Play.
25. General
These Terms, together with our Subscription, Cancellation & Refund Policy, any supplemental terms we present for specific services or promotions, and any signed agreement between you and us, are the entire agreement. Our Website Privacy Notice, Consumer Health Data Privacy Notice, and other privacy or accessibility notices are notices and aren't part of this agreement. If a signed agreement conflicts with these Terms, the signed agreement controls. If these Terms conflict with the Subscription, Cancellation & Refund Policy about billing, cancellation, or refunds, the Subscription, Cancellation & Refund Policy controls.
You agree that we may provide notices and other communications to you electronically, and that they satisfy any legal requirement that such communications be in writing.
If a provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, consistent with its original intent, and the rest of these Terms stays in effect. Our failure to enforce a provision isn't a waiver. We may assign these Terms; you may not assign them without our written consent. We aren't responsible for delays or failures caused by events beyond our reasonable control, including cyberattacks, pandemics, government actions, and failures or outages of third-party services we rely on, such as hosting or payment providers. These Terms don't create any agency, partnership, joint venture, employment, or fiduciary relationship. These Terms won't be construed against us because we drafted them. Headings are for convenience only.
These Terms are written in English. If a translated version conflicts with the English version, the English version controls.
